1. Our services and who these terms cover

We provide bespoke digital agency services, including web design, Shopify and e-commerce work, AI-assisted media, content production, video editing, branding, and agreed launch support. Services are offered through an individual quote or proposal, not as a promise that every displayed service is included in a single package. We do not currently supply physical goods. Any future ready-made download, subscription, or physical product requires its own clear description and applicable terms before purchase.

These terms apply to both business clients and consumers where incorporated into an accepted proposal. A person acting for a business must have authority to enter the agreement. A consumer's rights under applicable mandatory law take priority over any conflicting provision.

2. Proposals and contract formation

A website enquiry, exploratory call, concept image, or indicative description does not itself create a paid order. Before you commit, our written proposal will identify the contracting parties, deliverables, exclusions, price and currency, applicable taxes or charges, payment stages, expected schedule, revision allowance, licensing arrangements, and any continuing services. We will explain any proposal expiry and conditions for starting work.

A contract is formed when you expressly accept the final proposal and we confirm the engagement in writing, unless the proposal clearly specifies another lawful acceptance process. We will provide the applicable terms before acceptance. An invoice alone does not change an agreed scope. Individually agreed project terms take priority over these general terms to the extent of a genuine conflict, but cannot remove non-waivable rights. Material changes require both parties' agreement.

3. Scope, changes, and collaboration

We will perform the agreed services with reasonable care and skill. The proposal defines what is included, such as page count, formats, integrations, content responsibilities, revision rounds, testing, and support. A request outside that scope will be assessed for its effect on fees and timing and requires your approval before additional chargeable work begins.

You will nominate an authorised contact, provide accurate information and materials you are entitled to use, and give reasonably timely feedback and access. We will explain dependencies and tell you when missing inputs affect delivery. A delay does not automatically authorise extra fees. Any revised schedule or additional charge must be reasonable, explained, and agreed where required.

4. Fees, deposits, and third-party costs

Only the fees, currency, taxes, expenses, and payment schedule disclosed and agreed in the proposal apply. There is no universal deposit percentage or automatically non-refundable booking fee. Deposits are credited against the project price and remain subject to the cancellation and refund rules and applicable law.

Platform subscriptions, domain registrations, paid themes, fonts, stock media, apps, advertising spend, and other third-party costs are included only if expressly stated. We will obtain approval before committing chargeable external purchases on your behalf and identify the licence holder and any renewal obligation. You may raise a genuine invoice dispute promptly with enough detail for us to investigate. We may pause affected work for overdue undisputed sums only after reasonable notice and an opportunity to resolve the issue, subject to your statutory rights.

5. Schedule, delivery, and review

Delivery milestones and dependencies are set out in the proposal. If no time is agreed, services will be performed within a reasonable time in the circumstances. We will notify you of a material delay and discuss a practical revised plan; this does not remove any remedy you have for late or failed performance.

We will provide an agreed review opportunity for drafts and deliverables. Your silence does not automatically waive defects or amount to acceptance of undisclosed changes. Approval of an identified design direction permits the next agreed stage, but does not remove rights relating to hidden defects or deficient services. Handover and support are described in the Delivery Policy and the proposal.

6. Ownership and permitted use

You retain ownership of materials you supply and grant us the limited permission needed to carry out the project. You should identify any restrictions before work begins. The proposal must specify which original final deliverables are assigned to you or licensed to you, the permitted uses, whether editable or source files are included, and when those rights take effect. Payment does not transfer rights that we do not own.

Our pre-existing tools, methods, reusable components, and unused concepts remain ours unless expressly agreed otherwise. Where one of these is included in a paid final deliverable, the proposal must give you the permission reasonably needed for the agreed use. We will not rely on an undisclosed restriction that prevents that use.

Third-party themes, software, fonts, music, stock assets, and AI services remain subject to their own licences. A customisation service does not itself give you a right to resell, duplicate, sublicense, or use a paid Shopify theme across additional stores. Required licences must be obtained from the authorised owner. We will identify material third-party restrictions and any recurring charges relevant to the agreed deliverables.

7. AI-assisted work and content approvals

Where AI tools are part of the agreed work, the proposal should identify their intended role and any material restrictions. AI output may contain errors, resemble other material, or have uncertain copyright or exclusivity status. We do not promise that an AI-generated element is unique, registrable, or protected by copyright in every country. Any specific clearance or exclusivity commitment must be expressly agreed and within our ability to provide.

We remain responsible for the care and skill required in our agreed services, including the agreed human review. You should check factual claims, product information, permissions for a person's likeness or voice, and suitability for your intended publication. We will not use confidential or personal material in an AI system without an agreed, appropriate handling arrangement. Neither party may ask the other to create unlawful, misleading, or infringing content.

8. Platforms, legal content, and outcomes

Shopify and other external platforms have their own terms, technical limits, and charges. We will explain material known dependencies. Platform approval, uninterrupted external availability, search ranking, advertising approval, revenue, and conversion results are not guaranteed unless a specific lawful commitment is expressly stated. These limitations do not excuse our failure to perform the work we agreed.

Launch and legal-content support means drafting assistance, formatting, or implementation within the agreed scope. It is not regulated legal advice, tax advice, or a guarantee that a business, store, or policy complies with every law. Country-specific legal advice and final approval must come from an appropriately qualified professional unless a separately identified professional engagement provides otherwise.

9. Confidentiality, privacy, and portfolio use

Each party will use the other's non-public project information only for the engagement and protect it appropriately. Access may be given to personnel or contractors who need it and are bound by suitable confidentiality obligations. This does not prevent disclosures required by law or use of information lawfully known, independently developed, or publicly available without a breach.

Personal data is handled as described in the Privacy Policy and any project-specific data-processing agreement. We will request permission before publishing your name, logo, unpublished work, or identifiable results as a case study. Public concept work must not be presented as an actual client engagement or verified client result.

10. Cancellation, termination, and handover

You may request cancellation in writing using the contact details above. Payment for work properly carried out and approved unavoidable third-party commitments will be assessed fairly under the Refunds and Cancellation Policy, without a blanket forfeiture of all advance payments.

If either party materially breaches the agreement, the other should explain the problem and allow a reasonable opportunity to remedy it where it can be remedied. Either party may terminate where the breach is serious and cannot be remedied or remains unresolved after that opportunity. We may refuse or stop unlawful work. Statutory cancellation or termination rights remain unaffected.

On termination, we will account for payments, work completed, and any refund due, and arrange reasonable transfer of client-owned materials and paid deliverables within the agreed rights. Confidentiality, accrued payment obligations, intellectual-property provisions, and rights intended to continue remain effective to the extent applicable. Client accounts or data will not be withheld where doing so would be unlawful.

11. Problems and responsibility

Please tell us about a defect or concern with enough detail to investigate. We will discuss appropriate correction, repeat performance, a price adjustment, or a refund according to the circumstances and applicable rights. A contractual support window does not shorten statutory remedies.

Each party remains responsible for losses for which it is legally liable. Reasonable steps should be taken to prevent avoidable loss. These general terms do not impose an arbitrary liability cap or a blanket exclusion of consequential loss. Any project-specific limit must be expressly agreed, fair and reasonable in the circumstances, and legally permitted.

Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or consumer protection that cannot lawfully be excluded or limited. A description of third-party risks is not a waiver of our own legal duties.

12. Disputes, governing law, and updates

Contact inquiry@spectrumagency.xyz first so that we can investigate and seek a practical resolution. Neither informal discussion nor any voluntary mediation prevents urgent relief or removes your right to approach a court, regulator, or other available dispute-resolution body.

The agreement is governed by Hong Kong law, subject to any mandatory protection that applies to you. Hong Kong courts have non-exclusive jurisdiction. If you are a consumer, this choice does not deprive you of mandatory protections of the law that would otherwise apply or require you to give up a right to bring a claim in a court available under that law.

If a provision cannot lawfully be enforced, the remaining provisions continue only so far as they can fairly operate without it. Updated website terms apply to future engagements unless an existing client expressly agrees to a lawful change. The version supplied with an accepted proposal continues to govern that engagement.

Privacy Policy

Last updated: 27 October 2026.
Service provider: SPECTRUMMEDIA AGENCY LIMITED, trading as Spectrum Media Agency.
Hong Kong Business Registration Number: 81463017.

1. Who is responsible and what this policy covers

SPECTRUMMEDIA AGENCY LIMITED is responsible for the personal data it collects through this website, enquiries, consultation requests and its own client administration. Privacy and data-access requests can be sent to our privacy contact using the email or postal address above. We handle personal data under applicable law, including Hong Kong's Personal Data (Privacy) Ordinance where applicable.

If we process a client's customer data solely on that client's instructions, the client's privacy notice and our agreed processing arrangements also apply. We do not acquire a right to use that data for our own marketing.

2. Information we collect and how we use it

Enquiries: your name, email address, message and any optional company or service details, to respond, discuss your project and prepare a proposal.
Consultation requests: contact details, requested date, time and time zone, and any optional project brief, to discuss and confirm a suitable appointment.
Client engagements: instructions, correspondence, feedback, relevant project files and authorised access, to perform and support the agreed services.
Administration: agreements, invoices, billing details, payment status and dispute records, where relevant to managing an engagement, accounting and legal obligations.
Website operation: technical information such as IP address, browser and device information, requests, usage information and cookies processed through Shopify for website functionality, security, preferences and platform performance.

Submitting an enquiry is voluntary. Our general enquiry form requires a name, email address and project message. Our consultation form requires a name, email address, requested date, time and time zone. Optional fields are identified on the form. Without the required information, we may be unable to respond, assess your request or prepare a proposal. Please do not submit passwords, payment-card details, identity documents or unnecessary sensitive information through these forms.

Submitting a consultation request is not a confirmed booking. We confirm arrangements separately. The displayed schedule does not reveal other clients' appointments or establish live availability or client volume.

We use information for the purposes explained at collection and directly related purposes, or another purpose only where lawfully permitted. Where applicable law requires a legal basis, this may include steps you request before a contract, performance of an agreement, legal obligations, our legitimate interests in operating and securing our business subject to your rights, or your consent where required.

3. Shopify, cookies and website features

Shopify hosts and operates this website and processes native contact-form submissions. Shopify may use cookies and similar technology for storefront operation, security, preferences, usage measurement and platform features. The information processed depends on the features used and the choices available to the visitor. We have not added Meta Pixel, Google Analytics or a separate third-party booking or CRM service.

You can use the website's cookie controls where available and your browser's settings to manage cookies. Blocking necessary cookies may affect forms or other functions. Where consent is required for non-essential cookies or similar processing, that consent must be obtained before the relevant processing; simply visiting this page or contacting us is not consent.

Shopify may act on our behalf or, for certain services, for its own purposes. Further details, including its privacy rights portal and processing practices, are available in Shopify's Privacy Policy and Cookie Policy.

4. Email, recipients and disclosures

Our current website and email workflow uses Shopify and Google Gmail. Shopify processes website and form information; email correspondence, including messages and attachments sent to us, is handled through Google Gmail. See Google's Privacy Policy for Google's processing and international operations.

Access is limited to authorised people who need the information for the purposes described. Information may also be disclosed to professional advisers where necessary, or to authorities or other recipients where required or permitted by law, for example to establish or defend a legal claim. We do not sell personal data or provide it to another organisation for that organisation's direct marketing.

If a project requires an additional provider or contractor to handle personal or confidential information, we will explain the relevant arrangement and put appropriate controls in place before that handling begins. Contact details displayed on this website are not an instruction to send sensitive project data through an unsecured channel.

5. AI-assisted work

Offering AI-assisted creative services does not mean that website enquiries or client information are automatically sent to an AI tool. We do not currently use an additional AI service to process identifiable client information. Before a project requires such processing, we will agree the relevant use, provider and safeguards, give any required further notice and obtain any required permission. Only information necessary for the agreed purpose should be supplied.

6. International processing

We are based in Hong Kong. Shopify and Google operate internationally, so information may be processed in Hong Kong, Canada, the United States and other countries where those providers and their service providers operate. Their linked policies describe their global processing and applicable transfer arrangements. We assess the safeguards relevant to our use of these services and apply any additional measures required by the law that applies to your information. Use of this website is not blanket consent to an otherwise unlawful transfer.

7. Retention and security

We retain personal data only for as long as necessary for the purposes described and applicable legal obligations. Relevant criteria include whether an enquiry remains active, the duration and support needs of an engagement, required business records, and a genuine need to resolve a dispute or legal claim. Hong Kong business records subject to the applicable recordkeeping rules are retained for at least seven years; this does not mean every enquiry or attachment is kept for seven years.

Information that is no longer needed is deleted or anonymised, subject to applicable legal requirements and the deletion cycles of relevant systems and backups. We take reasonably practicable steps to protect data against unauthorised or accidental access, processing, loss, erasure or use, including restricting access to those who need it. No internet service can guarantee absolute security.

8. Marketing choices

An enquiry, consultation request or engagement does not automatically subscribe you to marketing. Where we propose to use personal data for direct marketing, we will provide the required information and obtain the necessary consent before doing so. You can ask us to stop direct marketing at any time through our contact email without a charge for opting out. Messages needed to respond to your request or administer an engagement are separate from marketing.

9. Your rights and complaints

You may request access to personal data we hold about you and correction of inaccurate data. Send your request to inquiry@spectrumagency.xyz, marked "Privacy request", or to our registered address above. Provide enough information to locate the relevant records, without unnecessary sensitive documents. We may make proportionate checks of identity or authority and will respond within applicable legal time limits.

Other rights, such as deletion, objection, restriction, portability or withdrawal of consent, may apply depending on your location and circumstances. We assess requests under the applicable law and explain any lawful restriction or permitted access-request fee. Withdrawing consent does not affect processing lawfully carried out beforehand.

You can raise a concern with us or contact the Hong Kong Office of the Privacy Commissioner for Personal Data. You may also have the right to complain to a supervisory authority where you live. Contacting us does not remove another available remedy.

10. Updates

We update this notice when our practices change and show the revision date above. Where a new use requires further information, a choice or consent, updating this page alone does not replace that requirement. Additional project-specific processing terms will be provided where relevant.

Digital Delivery Policy

Last updated: 27 October 2026.
Service provider: SPECTRUMMEDIA AGENCY LIMITED, trading as Spectrum Media Agency.
Hong Kong Business Registration Number: 81463017.
Registered and correspondence address: Unit B53, 2/F, Kwai Shing Industrial Building Phase 1, 36-40 Tai Lin Pai Road, Kwai Chung, N.T., Hong Kong.
Email: inquiry@spectrumagency.xyz.
Telephone: +1 743 240 5591.

1. Digital services, not physical shipping

Our current offering consists of bespoke agency services delivered digitally under an accepted quote or proposal. Deliverables may include website or Shopify work, design files, branding assets, media, edited video, content, and agreed documentation. We do not currently ship physical goods. Shipping carriers, parcel tracking, physical delivery charges, and return postage therefore do not apply to these services.

A service page is an invitation to discuss a project, not a promise of an instant download. Any future ready-made digital product or physical item will require a separate, accurate delivery description before purchase.

2. The project delivery plan

Before work starts, the proposal will describe the deliverables, formats, milestones, review stages, expected delivery dates or estimates, relevant dependencies, and handover method. Any essential launch deadline must be expressly agreed. The plan should distinguish a firm commitment from an estimate and say whether editable files, source code, implementation, training, or ongoing support are included.

Work begins under the start conditions agreed in the proposal, which may include acceptance, an agreed deposit, and receipt of necessary client materials or access. Where no performance time is agreed, we will perform within a reasonable time in the circumstances. Turnaround depends on the agreed scope and project requirements.

3. Client materials, access, and approvals

We will identify the information and access reasonably needed, such as approved brand assets, copy, product details, legal approvals, licensed media, or appropriate Shopify collaborator permissions. You should provide accurate materials you have the right to use and nominate a person who can give project decisions.

Use an agreed secure channel for sensitive files and account access. Do not send passwords or private customer datasets through an ordinary contact form. Prefer role-based or collaborator access with only the permissions required. Personal data should be supplied only under an appropriate processing arrangement.

If missing inputs, changed instructions, or delayed feedback affect a milestone, we will explain the impact and agree a reasonable revised plan. Additional fees require the approval provided for in the agreement; a delay is not automatic permission to charge more.

4. Delivery methods and technical requirements

Depending on the project, delivery may be through an agreed secure download, a shared project workspace, an approved repository, direct configuration of your platform, or transfer of authorised files and accounts. We will identify the actual handover location and provide the instructions reasonably needed to access and use the deliverables.

Relevant software, file formats, supported environments, platform plans, licences, or account ownership requirements should be disclosed before acceptance. Third-party subscriptions and theme licences are not included unless the proposal says so. A deliverable cannot transfer rights or access that belong to a third party without authorisation.

Time-limited download access or archive limits, if used, will be communicated before handover with a reasonable opportunity to retrieve the files. We will not invent an undisclosed expiry. Tell us if an agreed delivery link fails so we can investigate and provide an appropriate alternative.

5. Review, revisions, and launch

The proposal sets out the review process and included revision rounds. We will give you a reasonable opportunity to check delivered work against the agreed brief. Clearly described new requirements can be handled as a separate approved change. Correcting a failure to meet the agreed specification is not automatically an optional paid revision.

A live launch, domain change, replacement of a published theme, or other material deployment requires the approval agreed for the project. We will distinguish a preview or concept from a live production release. Silence alone does not waive problems or create acceptance of undisclosed changes.

Any training, maintenance, backup service, post-launch support, or monitoring commitment must be stated in the proposal. The end of an agreed support period does not remove rights relating to defective or incomplete services.

6. Delays and failed delivery

If we become aware of a material delivery problem, we will tell you, explain the practical effect, and discuss reasonable next steps. External platform outages or events outside reasonable control may affect scheduling, but are not a blanket exemption from our duties. We will take reasonable steps to reduce disruption.

Where a revised arrangement is not acceptable or the law gives you a right to cancel, repeat performance, a price reduction, a refund, or another remedy, those rights remain available. See the Refunds and Cancellation Policy and contact inquiry@spectrumagency.xyz with your project reference and the affected deliverable.

7. Completion and secure handover

At completion or termination, we will identify what has been delivered, any agreed outstanding items, applicable licence information, and responsibility for ongoing subscriptions or administration. Client-owned accounts should remain under the client's control. Access no longer needed should be removed, and credentials should be rotated where appropriate.

File retention, return or deletion of personal data, and any later retrieval service must follow the agreed arrangements and applicable law. This policy does not promise indefinite storage. Cancellation balances and any refund are handled fairly under the agreement and the Refunds and Cancellation Policy.

Refunds and Cancellation Policy

Last updated: 27 October 2026.
Service provider: SPECTRUMMEDIA AGENCY LIMITED, trading as Spectrum Media Agency.
Hong Kong Business Registration Number: 81463017.
Registered and correspondence address: Unit B53, 2/F, Kwai Shing Industrial Building Phase 1, 36-40 Tai Lin Pai Road, Kwai Chung, N.T., Hong Kong.
Email: inquiry@spectrumagency.xyz.
Telephone: +1 743 240 5591.

1. Scope and your legal rights

This policy covers our bespoke digital agency services ordered through an accepted quote or proposal. There are no physical goods to return under the current offering. A ready-made digital download, subscription, or future physical product would need appropriate additional terms disclosed before purchase.

We do not apply a blanket “no refunds” rule, and an advance payment is not automatically forfeited because a project is customised. Nothing in this policy removes a mandatory right to cancellation, withdrawal, correction, repeat performance, a price reduction, a refund, damages, or another remedy under applicable law. Where such a right is more favourable, it takes priority.

2. How to request cancellation or report a problem

Contact inquiry@spectrumagency.xyz with your name, project or invoice reference, and the request or issue. You may identify a preferred remedy and include relevant examples. Do not include full payment-card details or unnecessary sensitive information. We will acknowledge the request, review the agreement and work records, and explain the proposed outcome and any amount payable or refundable.

Contacting us is intended to make resolution easier, not to impose a requirement that prevents you from using a statutory complaint, payment-provider dispute process, or court remedy. Please let us know of an issue reasonably promptly so that we can investigate; this does not create a shorter claim period than the law allows.

3. Cancelling before or during a project

You may request that future work stop. We will take reasonable steps to avoid further unnecessary costs once we receive the request. Subject to any applicable statutory cancellation rules, the cancellation balance should reflect only a fair amount for agreed services properly performed up to cancellation and specifically approved third-party commitments that cannot reasonably be avoided or recovered.

Charges will be proportionate to the agreed price, the work actually performed, and the value delivered, not an arbitrary penalty or the automatic full remaining project price. We will provide an understandable breakdown, account for amounts already paid, and refund any excess advance payment. Where no chargeable work or approved unavoidable cost has arisen, the unused advance is refundable.

We will seek reasonable recovery or cancellation of external commitments and pass on any relevant recoveries. Any proposed deduction for a third-party cost must have been disclosed and approved, be properly supported, and be legally permitted. A third party's restrictive policy does not by itself remove your rights against us.

4. Consumer withdrawal and early performance

Some countries give consumers specific pre-contract information and withdrawal rights for distance contracts, digital content, or services. A worldwide agency cannot assume that one identical rule applies everywhere. We will give the information, cancellation method, and any required model form or local terms applicable to your transaction before you commit.

If you ask us to begin during a legally applicable withdrawal period, any required express request and acknowledgement must be obtained separately and clearly. Paying an invoice, submitting an enquiry, accepting a general privacy policy, or merely describing a project as custom does not automatically waive statutory rights. Any lawful deduction for early performance or loss of a withdrawal right must satisfy the requirements of the applicable law.

5. Incomplete, defective, or late services

If work fails to meet the agreed specification or the standard required by law, tell us what is wrong. We will investigate and propose a fair remedy, which may include correction or repeat performance within a reasonable time and without an additional charge for remedying our own failure.

Where correction is not possible, is not provided appropriately, or another remedy is required by the circumstances or applicable law, a proportionate price reduction, refund, cancellation, or other remedy may be due. An opportunity to investigate or correct a problem is not an exclusive remedy and does not require you to accept repeated failed attempts.

A change of preference after compliant work has been completed is different from a defect; additional creative directions may be handled through an agreed change. Conversely, describing a defect as a revision request does not make it chargeable. Approval of a draft does not remove rights in relation to concealed defects or deficient services.

6. If we cancel or cannot complete the work

If we cannot deliver an agreed material part of the project, we will explain the situation and discuss whether an acceptable alternative is possible. You do not have to accept an undisclosed substitute. We will refund sums due for services not provided, account fairly for any usable work already delivered, and respect any wider remedy required by law.

If termination follows a material breach, the agreement and applicable law determine the consequences. We will provide a reasoned accounting rather than treating every termination as a forfeiture of deposits. Client-owned materials and paid deliverables will be handled under the agreed rights and a reasonable handover process.

7. How an approved refund is paid

We will process an approved or legally due refund without undue delay and within any applicable statutory deadline. Unless the law requires otherwise, it will be returned to the original payment method where possible. If that is unavailable, we will agree a secure alternative and will not impose a substitute credit or voucher where you are entitled to money back.

We will confirm the amount, currency, basis, and expected processing steps. The receiving bank or payment provider may take additional time to display the credit; this does not extend a legal deadline applicable to us. We will explain the expected processing time for the applicable payment method.

No undisclosed administrative deduction applies. Any currency conversion or provider fee relevant to the transaction must be handled transparently and only to the extent lawful. We may use proportionate verification to prevent misdirected refunds, without unnecessary obstacles.

8. Escalation and resolution

If you disagree with our assessment, reply with the points you want reviewed. We will reconsider the relevant evidence and explain our position. You remain free to seek independent advice, use an available consumer or regulatory complaint route, or exercise other legal rights. The governing-law and jurisdiction provisions in the Terms of Service preserve mandatory consumer protections.
